These Terms are designed to comply with the Information Technology Act, 2000, applicable Indian laws, Meta (WhatsApp) Business Messaging Policies, and RCS messaging compliance standards.

- “User” means any individual or entity accessing or using the Services.
- “Platform” means WhatsApp Business API, RCS platforms, and related systems.
- “Content” includes messages, media, templates, data, and communications sent using our Services.
- “Meta” refers to Meta Platforms Inc., including WhatsApp.
- “RCS” refers to Rich Communication Services supported by telecom operators.
Acceptance of Terms
By registering, accessing, or using our Services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must immediately discontinue use of our Services.
Your continued use constitutes ongoing acceptance of any updated Terms.
Description of Services
Gaurav Patil provides business messaging solutions including:
- WhatsApp Official Business API onboarding and integration
- RCS business messaging services
- Message template creation and approval support
- Customer communication automation
- Analytics and delivery reporting
- Compliance advisory related to messaging platforms
We act as a facilitator and technology service provider and do not control end-user behavior or telecom network availability.
Eligibility
To use our Services, you must:
- Be at least 18 years of age
- Have legal authority to bind your business
- Operate a lawful business under Indian law
- Comply with Meta and RCS messaging policies
We reserve the right to refuse service to anyone at our discretion.
Account Registration
Users may be required to create an account by providing accurate and complete information. You are responsible for maintaining confidentiality of login credentials and all activities conducted through your account.
Any misuse, unauthorized access, or breach must be reported immediately.
User Responsibilities
You agree to:
- Send messages only to users who have explicitly opted in
- Avoid spam, fraud, misleading, or prohibited content
- Comply with all applicable laws, Meta policies, and RCS regulations
- Maintain valid customer consent records
- Not misuse the platform for illegal or unethical purposes
Violation may result in immediate suspension or termination.
Payment & Billing Terms
All fees are payable as per agreed pricing plans. Payments must be made in advance unless otherwise agreed in writing. Late payments may result in service suspension.
All charges are exclusive of applicable taxes under Indian law.
Subscription Renewal & Termination
Subscriptions may auto-renew unless canceled. We reserve the right to terminate services for policy violations, non-payment, or regulatory compliance issues without prior notice.
Termination does not absolve payment obligations.
Use of WhatsApp Official API & RCS
Use of WhatsApp and RCS services is subject to:
- Meta Business Messaging Policy
- WhatsApp Commerce Policy
- Telecom operator rules governing RCS
We are not responsible for suspensions imposed by Meta or telecom providers.
Message Delivery & Compliance Policy
Message delivery is dependent on network availability, recipient device compatibility, and third-party platforms. Gaurav Patil does not guarantee delivery rates or response times.
Users must ensure compliance with DND, TRAI, and anti-spam laws.
Intellectual Property Rights
All platform content, software, trademarks, documentation, and materials belong to Gaurav Patil or its licensors. Users receive a limited, non-transferable license to use the Services.
Unauthorized copying or redistribution is prohibited.
Confidentiality
Both parties agree to protect confidential information including business data, credentials, pricing, and customer information.
Confidentiality obligations survive termination.
Disclaimer of Warranties
Services are provided “as is” and “as available.” We disclaim all warranties including merchantability, fitness for a particular purpose, and uninterrupted availability.
Limitation of Liability
To the maximum extent permitted by Indian law, Gaurav Patil shall not be liable for indirect, incidental, or consequential damages including loss of profits, data, or goodwill.
Total liability shall not exceed the amount paid in the preceding three months.
Indemnification
You agree to indemnify and hold harmless Gaurav Patil from any claims arising out of your misuse of the Services, violation of law, or breach of these Terms.
Governing Law (India)
These Terms shall be governed by and construed under the laws of India. Courts located in Maharashtra shall have exclusive jurisdiction.
Changes to Terms
We reserve the right to modify these Terms at any time. Continued use constitutes acceptance of revised Terms.
